In compliance with the GLBA, I do not share nonpublic personal information about a consumer with any non-affiliated third party, unless allowed by law.
I protect nonpublic personal information of my clients, and their customers and consumers (when my client is a lender, title agent, attorney, etc.)
I allow access to information on need-to-know basis only, and only to those parties verifiably in prior possession of said information. This includes confirmation with a client of information contained on documents delivered or sent to me by that client, or that client's verifiable affiliate, who has retained my services for or on behalf of their customer or consumer.
I maintain a secure & dedicated home office and practice due diligence with all electronically sent or received information and documents. Due diligence with electronic information includes the utilization of password protection, encryption measures and devices, firewalls, and limited access by any other person. No person other than me has access to my business-dedicated and secure computer or any information stored on that computer or back-up drives.
My home office is secured with a high level of physical security, under 24 hr Surveillance by a CCTV Security Camera System, and equipped with a state of the art alarm system that is monitored by a U.L. Listed monitoring company.
Any and all computer service (such as updating, repair, installations, etc) are done on-site, under my direct supervision.
All printed documents that contain non-public personal information that are not returned to the client or their customer, are cross-shredded.
All records containing non-public personal information, both electronic and printed are purged upon completion of the transaction, which includes my receipt of payment for that transaction. All business records that remain for my business and tax purposes are limited to my invoices and each client's transaction confirmation only.
I maintain a Notary Journal. This journal is kept secured or in my immediate possession at all times, and the information contained is only available under court subpoena, and only specified line items.
I am not an attorney and therefore, by law, I cannot explain or interpret the contents of any documents for you, instruct you on how to complete a document or direct you on the advisability of signing a particular document. By doing so I would be engaging in the unauthorized practice of law , and could face legal penalties that include the possibility of incarceration. Any important questions about your document should be addressed to the lender, title company or an attorney.

IDENTIFICATION REQUIREMENTS
Each signer must present at least one of the forms of ID listed below. The ID must be current or, if expired, have been issued within the last 5 years; contain the signer's photograph, personal description, and signature; and bear a serial or other identifying number.
· Driver's License or non-driver's ID card issued by a U.S. state.
· U.S. passport
· Foreign passport stamped by the U.S. Citizenship and Immigration Services (USCIS).
· US Military Identification Card that contains all required elements stated above,
(The Common Access Card 'CAC' is not acceptable).
· Inmate ID Issued by the Dept. of Corrections.
· Employee Card issued by an agency or office of the state or any city, county or city and county within the state.

A Credible Witness is a person (whose identity has been established by the Notary according to above identification requirements) who personally knows you and establishes your identity via an oath. (The Notary has to personally know the Credible Witness if he/she is validating the identity of a person with only one Credible Witness, otherwise TWO credible witnesses are needed).
A Notary Public is an official of integrity appointed by state governmenttypically by the secretary of state to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents. These official acts are called notarizations or notarial acts. Notaries are publicly commissioned as ministerial officials, meaning that they are expected to follow written rules without the exercise of significant personal discretion, as would be the case with a judicial official.
It is the foremost duty of a Notary to screen the signers of particularly sensitive instruments such as property deeds, wills and powers of attorney for their true identity, their willingness to sign without duress or intimidation, and their awareness of the general import of the document. Some notarizations also require the Notary to put the signer under an oath declaring under penalty of perjury that the information contained in a document is true and correct.
Impartiality is the byword of the Notary office and the foundation of its public trust. Notaries are duty-bound not to act in situations where they have a personal interest. The public trusts that the Notarys critical screening tasks have not been corrupted by self-interest. And impartiality dictates that a Notary never refuse to serve a person due to race, nationality, religion, politics, sexual orientation or status as a non-customer.
As official representatives of the state, Notaries Public certify the proper execution of many of the life-changing documents of private citizens whether those diverse transactions convey real estate, grant powers of attorney, establish a prenuptial agreement, or perform the multitude of other activities that enable our civil society to function.
In this modern era when business transactions between complete strangers are the norm rather than the exception, Notaries engender a trust that the critical signed documents we rely on are authentic. Such trust enables the sensitive documents of commerce and law to be exchanged between strangers with full confidence in their reliability.
The Purpose
Notarization is the official fraud-deterrent process performed by Notaries Public that renders the important documents of everyday life as trustworthy. It is a three-part process of vetting, certifying and record-keeping. Notarizations are also called notarial acts.
Above all, notarization is the assurance by a duly appointed and impartial Notary Public that a document is authentic, that its signature is genuine, and that its signer acted without duress or intimidation, and intended the terms of the document to be in full force and effect.
The central value of notarization lies in the Notary’s impartial screening of a signer for identity, willingness and awareness. This screening detects and deters document fraud, and helps protect the personal rights and property of private citizens from forgers, identity thieves and exploiters of the vulnerable. Across the nation every day, the process of notarization prevents countless forged, coerced and incompetent signings that would otherwise overwhelm our court system and dissolve the network of trust allowing our civil society to function.
The Different Notarial Acts
There are three major kinds of notarial act — acknowledgments, jurats and copy certifications:
Acknowledgments. The acknowledgment is typically performed on documents controlling or conveying ownership of valuable assets. Such documents include real property deeds, powers of attorney and trusts. For an acknowledgment, the signer must appear in person at the time of notarization to be positively identified and to declare (“acknowledge”) that the signature on the document is his or her own, that it was willingly made and that the provisions in the document are intended to take effect exactly as written.
Jurats . The jurat is typically performed on evidentiary documents that are critical to the operation of our civil and criminal justice system. Such documents include affidavits, depositions and interrogatories. For a jurat, the signer must appear in person at the time of notarization to sign the document and to speak aloud an oath or affirmation promising that the statements in the document are true. (An oath is a solemn pledge to a Supreme Being; an affirmation is an equally solemn pledge on one’s personal honor.) A person who takes an oath or affirmation in connection with an official proceeding may be prosecuted for perjury should he or she fail to be truthful.
Certified Copies. The copy certification is performed to confirm that a reproduction of an original document is true, exact and complete. Such originals might include college degrees, passports and other important one-and-only personal papers which cannot be copy-certified by a public record office such as a bureau of vital statistics and which the holder must submit for some purpose but does not want to part with for fear of loss. This type of notarization is not an authorized notarial act in every state, and in the jurisdictions where it is authorized, may be executed only with certain kinds of original document.
The Parts of a Notarization
The Notary’s screening of the signer for identity, volition and awareness is the first part of a notarization.
The second part is entering key details of the notarization in the Notary’s “journal of notarial acts.” Keeping such a chronological journal is a widely endorsed best practice, if not a requirement of law. Some states even require document signers to leave a signature and a thumbprint in the Notary’s journal.
The third part is completing a “notarial certificate” that states exactly what facts are being certified by the Notary in the notarization. Affixation of the Notary’s signature and seal of office on the certificate climaxes the notarization. The seal is the universally recognized symbol of the Notary office. Its presence gives a notarized document considerable weight in legal matters and renders it genuine on its face (i.e., prima facie evidence) in a court of law.
Q: What functions do Notary Signing Agents perform?
A: The Notary Signing Agent meets with the borrower at a designated location, ensures that the borrower signs,
initials and dates the loan documents in all appropriate places and then notarizes the borrower's signature where necessary. Once this is completed, it is the Notary Signing Agent's responsibility to see that the signed and notarized loan documents are delivered to the closing agent or other designated office.
Q: Why is there a need for Notary Signing Agents?
A: The concept of having a specialized witness visit a borrower's home or business to expedite loan signings was
unknown before the 1990s. In the past, able-bodied borrowers would have to travel to a lending, escrow or title office to sign loan papers. However, record low interest rates, a boom in refinancings, a growing corporate preference for "out-sourcing" and demands for faster service have changed signing procedures. In today's competitive loan market, borrowers no longer tolerate the inconvenience of having to leave work or home to sign loan papers. Therefore, closing or signing agencies contract with Notaries who travel to the borrower and ensure that the needed documents are correctly and expeditiously signed, dated, notarized and returned.
Q: How does this benefit the borrower?
A: By meeting the borrower at home or another convenient location for the signing, the Notary Signing Agent
eliminates the need for a time-consuming trip by the borrower to close the loan. This is more convenient for both
the closing agent and the borrower. The Notary Signing Agent also provides assurance that the signed and notarized documents will be delivered by the pertinent deadline.
Q: Why use Notaries for this service?
A: Notaries, in their unique role as public officers employed in private enterprise, are required by law to display a
high level of honesty and integrity in their work, which gives lenders confidence in them as trustworthy Signing
Agents. In addition, Notaries can be found in every part of the United States, providing a reliable nationwide
resource for borrowers that is available even in remote locations.
Q: What are the requirements for a Notary Signing Agent?
A: First, the person must be a commissioned Notary Public. Each state has different requirements for Notary
applicants. The Notary Signing Agent must be well-versed in correct notarization procedures and familiar with
the documents being presented to borrowers. A good Notary Signing Agent is professional, well-organized and,
above all, highly responsible. Notary Signing Agents can also distinguish themselves by completing a specialized certification program that recognizes them as competent and knowledgeable in the field. Certified Notary Signing Agents are in great demand by lenders.
Q: Who selects the Notary Signing Agent?
A: A closing agent, who may be an escrow officer or attorney, may select a Notary Signing Agent directly, or
request a Notary's assistance through a third-party document signing service or other intermediary. Many closing firms and signing services keep lists of Notaries on file in order to locate a Notary quickly.
Q: What are the costs for Notary Signing Agent services?
A: The Notary Signing Agent's fee covers tasks beyond notarization that usually include identifying document signature spaces, courier services, and ensuring that the package is returned to the issuing agency in a timely
manner. Like attorneys or real estate agents who also are Notaries, Notary Signing Agents wear "two hats," deriving income not only from their notarial services, but also for performing other functions. Fees for Notary Signing Agent services vary according to the type of transaction, amount of travel involved, extra duplication & handling of documents, & the amount of advance notice provided on the signing. Usually, these costs are included by the title company as part of their closing/settlement fees. Most state laws regulate fees that can be charged for each notarization and these fees should be recorded in a journal of notarial acts. The additional income for services as a Notary Signing Agent may also be noted in the journal or in a separate log kept for that purpose.
Q: Does the Notary Signing Agent replace an attorney or closing agent?
A: No. The Notary Signing Agent is prohibited by law from preparing documents or answering specific questions
about the loan. If the borrower has questions during the signing, the Notary must refer them to the closing agent
or the lender. Notary Signing Agents work for closing agents. The Notary Signing Agent's duty is to make sure each signer is physically present and is identified appropriately, that all documents are signed and initialed, and that each signature that requires notarization is properly notarized. The Notary Signing Agent is also responsible for ensuring that the documents are returned to the lender.
1) The document signer must personally appear face to face before the Notary at the time of notarization not before not later.
2) The Notary must positively identify each & every document signer by reliable identification, by credible witness, or through personal knowledge to prevent forgery.
3) The Notary must be an impartial and disinterested party to the transaction & in the performance of their duties.
4) The Notary must not notarize or certify a copy of a birth certificate or other vital record despite what someone may have been told by a travel agency or airline.
5) The Notary must speak a common language with the document signer & not use an interpreter.
6) The Notary must make a record in their journal of each notarial act & have each document signer sign the entry at the time of notarization to protect the document signer’s legal interests.
7) The Notary must hold and scan each document for completeness, blank spaces, as well as the type of document & notarization for recording in their journal.

A field chase, also known as a “door knock,” is a tool used to effectively mitigate any potential losses. Companies who are having difficulty making contact with their customer or trying to verify location of their collateral will utilize a field chase service.
When contact is initiated I always attempt to put your client on the phone with you. Unfortunately I am not a collection agency and do not act as a 3rd party debt collector. If your client wants to pay at the time of visit - I will attempt to put them on the phone with you so you can coordinate a method of payment, whether its a check by phone, western union quick collect or money gram. I know how long and hard youve attempted to make contact. I always make sure that every opportunity for contact is not missed.
