HIRE AGREEMENT
Hire Agreement
Conditions of Hire;1.I agree that the Terms and Conditions hereof embody the whole agreement between MAD Camper and Trailer Hire and me and that no variation will bind MAD Camper and Trailer Hire unless it is in writing and signed by Michael and Lynn Durai.2.In this agreement:-i.Owner means MAD Camper and Trailer Hire for or on whose behalf this agreement is entered into and its respective servants or agents.ii.Hirer means the person named on the face of hereof who signs this agreement and any person whose agent signs this agreement.iii.Camper Trailer means the Camper Trailer (including registration number) hired from MAD Camper and Trailer Hire, by the hirer, its components, spare parts and all associated equipments and accessories.iv.Period of Hire means the agreed time the Camper Trailer is hired, commencing at agreed start date, and ending upon the return of the camper trailer at agreed finish date. Collection and Return of Camper Trailer must be between 3.30pm and 5.30pm. A late fee of $50 may be charged.v.Security Bond means the portion of the hire fee which will be refunded to the hirer, upon the undamaged and clean return of the camper trailer, less any deductions for loss or damage (see inventory) and or cleaning or late fee.3.The owner hereby hires the camper trailer to the hirer and the hirer shall take on the hire of the camper trailer as a bailee for the period upon the terms and conditions hereinafter set forth.4.The hirer acknowledges:-i.That the camper trailer is clean and in good repair and condition, roadworthy and registered, appropriate tyres and pressure and fit the hirers purpose in relation to the purpose journey and driving abilities.ii.The hirer undertakes to return the camper trailer in the same condition or shall agree to pay for any loss or damage in full. Damage may include paint damage and tyres.iii.Any and all traffic infringements, parking fines, towing and transport fees, legal costs incurred by the hirer, are at the hirers expense. The hirer agrees to pay any and all such fines in full.5.The hirer warrants:-i.I am 21 years or over.ii.I currently hold a valid drivers licenceiii.That the information provided by the hirer is true, accurate and correct.6.The hirer agrees:-i. To pay the owner a $50.00 booking fee (non refundable), to secure the dates of hire.ii.To pay the owner a $300.00 security bond or $500.00 security bond for long term hire, and provide signed copy of hereof agreement prior to departure. Security Bond will be refunded within 5 working days, to allow for a FULL Inspection of the Camper Trailer and quotes for any repairs.iii.To pay the owner the full amount of the Hire Cost, 5 days prior to the commencement of the period of hire. iv.That the hirer is liable for any damage to the underside of the camper trailer caused during the hire period. v.At all times the hirer will tow the camper trailer in a careful and cautious manner and comply with all rules and regulations, consistent with the use of a motor vehicle. vi.The hirer accepts full responsibility for the care and security of the camper trailer at all times. The hirer is totally responsible for any loss, damage, stolen or mislaid components or equipment of the camper trailers and ALL accessories and equipment. vii.Pets or any animals are not to be kept or transported within the camper trailer.viii.No article whatsoever will be placed, tied or carried on the tonneaux cover of the camper trailer, at any time during the period of hire. 7.The hirer undertakes:-i.That the hirer will not, without the written consent of the owner, part with possession of the camper trailer, sublet the camper trailer, permit or authorise the camper trailer to be towed by any person other than the hirer or the hirers agent. ii.The hirer must not, without the prior written consent of MAD Camper and Trailer Hire, modify, or permit any modification of the camper trailer in any way whatsoever.iii.At no time will the hirer tow, or allow others to tow the camper trailer whilst they are under the influence of drugs or alcohol. iv.At no time will the hirer will tow or store the camper trailer in a careless, reckless or dangerous manner, which may endanger the lives of themselves or others.v.The hirer will obey all road rules and speed limits, especially when driving on beaches, and display caution and drive to conditions where necessary.vi. The hirer will not drive or park the camper trailer on the beach where it is at risk of being flooded or damaged by the tide. The hirer will not park the camper trailer below the High Tide Line. The hirer, will be liable for all costs associated with this action.8.My attention has been expressly drawn to the Conditions of Hire for the Hire of the Camper Trailer from MAD Camper and Trailer Hire, which I acknowledge that I have read and understood;i.I acknowledge that it is my responsibility to read and familiarize myself with the operators manual.ii.I acknowledge that it is my responsibility to correctly apply the handbrake when parking and setting up the camper trailer, before unhitching it from my vehicle. iii.I acknowledge that it is my responsibility to correctly disengage the handbrake override, before towing the camper trailer.iv.I acknowledge that it is my responsibility to correctly raise the stabilising legs before towing the camper trailer.9.The hirer acknowledges the suitability of their vehicle for towing the camper trailer and that the hirer has full comprehensive insurance covering their vehicle while towing a trailer.10. In the event of any damage occurring to the camper trailer or mechanical difficulty manifesting itself, or any accident occurring in which the camper trailer or the hirer vehicle is involved forthwith, the hirer will notify the owner by telephone giving full details ASAP, and at a later date to the insurance company in writing.11. The hirer agrees to pay any amount of insurance excess payable arising out of any damages claim as a result the hirers use of the camper trailer.12.The hirer shall indemnify MAD Camper and Trailer Hire of any loss (including legal costs) incurred by MAD Camper and Trailer Hire in relation to any breach of the agreement and for any liability arising out of any such breach.
