Ontario Ministry of Education Act, Bill 212
In 2000 the Education Act introduced Bill 212, a revision dealing with the increasing incidents of violence, bullying, possession of weapons and illicit drugs in Ontario's public schools. The Ac t did not provide for a "zero tolerance" provision per se but increased power given to administrators and educators resulted in an excess of suspended and expelled students. As a result the Ontario Human Rights Commission submitted several appeals on behalf of suspended students and their families to school boards and Ontario Family Courts. Involving external agencies in student-school disputes doesn't address a lack of support for students with behavioural issues, their peers and educators.
HUMAN RIGHTS IN ONTARIO PUBLIC SCHOOLS
Human Rights have long been a part of Ontario's school issues but since the enactment of Bill 212 the school community appears to be turning to the Human Rights Commission of Ontario on a more frequent basis to resolve issues in Ontario school systems. This is not necessarily due to an increased need for the involvement of the Human Rights Commission in addressing parent, teacher and student concerns but rather an increased political and legal awareness of its use in Ontario schools.
The Ontario Special Education Act ... introduced in 1980 as Bill 82 addresses the needs of students with both behavioural and academic issues. The development of zero tolerance policies in the schools in 2000 conflicted with Bill 82 for students with behavioural issues. One argument stated that Bill 212 targeted minority stuents and students with behavioural needs since they comprised the majority of student suspensions and expulsions. Bill 81, a revision to Bill 212 suggested alternatives to suspensions and expulsions stressing that Principals give weight to MITIGATING FACTORS affecting student conduct.
