About Us
David R. Payne is a native of Asheville, North Carolina. After finishing law school in 1992, David came back to his home in Asheville and opened a general practice law firm. Initially the firm focused on all areas of law; however, it eventually evolved into a federal criminal law practice as well as a practice which focused upon various aspects of insurance defense work such as defense of worker's compensation claims and personal injury claims. In 1996 the firm went in a different direction wherein the main focus began to include the representation of worker's compensation clients, personal injury clients, and various matters involving criminal charges. During the real estate boom 2000-2006 the law firm focused additional efforts on real estate closings, large real estate transactions and development law. With the fall of the market, the firm has shifted towards the areas of foreclosure defense, developer defense and intense bank litigation. Currently the firm enjoys practice in the following areas: bank litigation, foreclosure deterrence and/or prevention, worker's compensation (victim), personal injury (victim) and a number of misdemeanor traffic offenses.

How do you charge for your services?
Answer -
For cases which involve worker’s compensation and personal injury, we only bill a fee if we win for you. Our Fee is typically 33% of whatever we recover on your behalf. On other cases, such as closings, we will a transactional amount for the legal representation (this is applicable to criminal matters as well).
