What does it mean that my house is in “foreclosure”?Foreclosure is the legal process by which your lender – sometimes called the mortgagee – seeks to take ownership of your property in order to satisfy the debt you owe.How do I know if I’m in foreclosure?In New York, foreclosure actions are commenced by the filing of a Lis Pendens (see below) against the property with the county clerk, and the service of a summons and complaint against the homeowner. If there is no Lis Pendens filed against the property and you have not been served with a summons and complaint, then you are not in foreclosure even though you may be behind or late on your mortgage payments.What is a “Lis Pendens”?A Lis Pendens is a legal notice that is filed with the county clerk in which the premises is situated that puts the world on notice that an action contesting ownership of the premises is currently pending in the court system. Literally, Lis Pendens means “suit pending” in Latin. The filing of a Lis Pendens is normally the first action taken by a bank in a foreclosure action in New York.I’m behind on my mortgage payments, how long does it take for the bank to place my loan in foreclosure?Historically, lenders placed homeowners into foreclosure after 90 days of missed payments. In New York, this timeframe has been extended as lenders have been grappling with an increasing amount of defaults. I haven’'t made a mortgage payment in more than three months, yet the bank hasn’'t placed my loan into foreclosure. Why?Reasons for your lender’s delay in placing your loan into foreclosure may vary from problems with your paperwork to a backlog in defaults being handled by the bank. Sometimes banks choose to delay initiating foreclosure proceedings for unidentified reasons. My lender commenced foreclosure proceedings- does this mean that the bank owns my home? No. In New York, the homeowner remains in full control of the title to the property up until the auction. This is the case even though the homeowner may not have made a mortgage payment in months or years. Can I sell my home while it is in foreclosure?Yes. In New York, the homeowner retains all rights to the property up until the foreclosure auction. This means that the homeowner can sell the home, subject to paying off the mortgage loan. If the sales price of the home is less than what is owed on the mortgage, the homeowner may be able to get permission from the bank for a “short sale.”How long does it take a bank to finish the foreclosure process?Typically, in New York, it can take a bank anywhere from 18 to 30 months to foreclose on a home.I’'ve been served with a summons and complaint.
