Collaborative law is a new way to resolve disputes taking the disputed matter from the litigious court room setting and moving it to the negotiating table. The goal is to create a win-win resolution.
As part of the collaborative law method, both sides retain separate attorneys whose job it is to help them settle the dispute. Going to court is not an option. If the collaborative process should break down, both attorneys are disqualified from any further involvement in the case.
Everyone involved in the process signs a contract in which they agree to disclose all documents relating to the issues; act in good faith; show respect for the other side and their points of view; insulate the children from the proceedings in order to minimize the impact of the conflict on them; share experts information and costs; solve the conflict outside of court.
Collaborative divorce is typically more cost-effective than litigation because cases are more likely to settle out of court. Because you and your spouse will learn to work out details in a collaborative way, you will learn the skills that will keep you out of court. The process is an investment in peace of mind and skill building for you, your spouse and your children for now and in the future.
The ending of a relationship puts the family into emotional turmoil.
The Collaborative law process recognizes that psychological issues exist that cannot be addressed by the legal system and specifically addresses these issues by bringing them to the forefront and using professionals such as a child specialist, a divorce coach, and a financial specialist as part of team approach to find solutions and support the family through the change process.
Collaborative Law uses a team approach to give families better support and guidance as they navigate through the divorce process, leaving a legacy of peace.
Collaborative team members include collaborative lawyers, divorce coaches and child specialists, and may also include financial specialists, mediators and real estate professionals.
I want to maintain a tone of respect even if we disagree
I want to protect my children as much as possible from the effects of divorce
I want to maintain control of the process and decisions rather than giving that power to the courts.
I want to work with my soon- to-be-ex spouse with good will.
I believe that working creatively and cooperatively together can resolve issues
I want to leave my marriage with the communication skills and good will needed to create a good co-parenting relationship for the sake of the children.
The collaborative model uses a team of two attorneys with the option of adding divorce coaches, a child specialist and a financial specialist if needed. Together the team helps the couple craft the parenting plan and financial settlement in a fair and respectful way so that relationships of goodwill are preserved, children are given a voice in the process, and the divorce stays out of court.
