Divorce varies in NY and CT.
For example, CT imposes a waiting period before entry of a judgment of divorce and NYS does not. Each are fault states, yet CT also provides for a no fault basis as well. As of October 15, 2010, New York is also a no fault divorce jurisdiction.
Post or Pre Nuptial and Separation Agreements are valid and enforceable if drafted with care. Each state has its own rules regarding such agreements and are tailored to the needs of the parties. This does not mean that these agreements are foolproof, but they should contain safeguards to prevent an attack.
Hire your lawyer prior to making an offer on your real estate!
Most clients hire an attorney AFTER they enter into an offer. It is best to be well informed prior to negotiating with any party, to avoid pitfalls, bad feelings and a a bad deal.
Prior to listing your realty or making an offer on one, its best to have all conditions of the sale specified clearly to the realtor, who works for you.
Especially in a bad economy, Sellers should be particularly aware of signing listing agreements with brokers regarding how a commission is earned. Call an attorney to protect yourself before signing a listing agreement.
The various areas I handle are mostly on behalf of Property owners representing them in evictions and leasing.
In New York eviction cases, known as Summary Proceedings are quickly resolved. In these actions, the Landlord can ask for the removal of the Tenant, licensee or squatter AND also ask for any unpaid rent and for “future rent” known as fair use and occupancy, along with a warrant of eviction.
In Connecticut, the process for eviction is a two part process. One being an action to remove the Tenant, and then another to seek to recoup unpaid rent.

Over these amounts, you may need structured estate planning to minimize your estate’s death tax.
Also, if your need a LIVING WILL or a Health Care Directive/Proxy, I also prepare those as well.
If you do not have a will when you die, then it will be up to the Courts to determine what is done with your property, according to how the State has determined such a situation to be handled.
