Whether you are a Business or an individual, managing waste legally and responsibly is something that has to be done correctly. For your information we have included details on some of the rules and regulations that you must adhere to below:
As a Business, you have a Duty of Care to manage your waste responsibly, which includes knowing where it ends up and how it will be disposed of, or recovered. Site Waste Management Plans
If you are running a construction or demolition project which is worth more than £300,000, then you will need to have a Site Waste Management Plan (SWMP). SWMPs are a legal requirement on any such site, they detail information on what waste types are in play and how they will be dealt with. Whether you are new to site management or have been in the game for a while, it is handy to know about the rules and regulations concerning Site Waste Management Plans (SWMPs). They have been a legal requirement since 6th April 2008 on all UK projects valued at £300,000 (ex V.A.T.) or more, with additional requirements in place for projects with a value of £500,000 (ex V.A.T.) or more.
They were introduced to make the responsible management of waste more important to both construction and demolition sites with a focus on promoting environmental sustainability. The SWMP regulations place the responsibility for the production of the plan with the client; who must produce it before the project is started. This is an important point to remember, as there are fines in place for clients and principle contractors that start a project without a Site Waste Management Plan.

What your SWMP must include:
If you run or own a business, then you have a legal duty to ensure that any waste you produce is handled safely and legally. This is your duty of care and it applies to any company or individual that produces commercial, industrial or household waste. Collectively, these waste types are known as Controlled Waste and include hazardous materials.
It is your duty of care as a business / producer of waste to check that anyone that processes your waste is authorised to take it. If you do not check that they are a legitimate waste broker and your waste ends up fly-tipped or illegally disposed of, you could be held responsible and fined.

Not every type of waste is controlled, for instance explosives, animal by-products and most radioactive wastes are excluded from your duty of care.
